General Terms

1. Scope and Subject Matter

These Terms and Conditions of Sale (hereinafter "T&C") govern all contractual relationships between HECC Certification and any individual or professional client wishing to benefit from electric and hybrid vehicle certification services, product purchases, or any other service offered via the hecc-certification.com platform or the HECC mobile application.

2. Acceptance of Terms

By placing an order on our online platform or via the HECC mobile application, the client is deemed to have unreservedly accepted these Terms and Conditions of Sale in their entirety.

3. Amendments

HECC Certification reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in force at the date of the order.

4. Reference Language

These T&C are drawn up in French and translated for informational purposes into English, Khmer and Chinese. In the event of any discrepancy between versions, the French version shall prevail.

5. Severability

If any clause of these T&C is declared null, void or unenforceable by a competent court, such nullity shall not affect the other clauses, which shall remain in full force and effect.

6. Assignment

HECC Certification reserves the right to assign or transfer all or part of its rights and obligations under these T&C to a third party, in particular in the event of merger, acquisition, restructuring or business transfer, without requiring the client's prior consent.

7. Certification Services

HECC Certification offers two levels of certification. The SILVER Certification provides a standardized diagnosis of battery condition and electric/hybrid systems using OBD2 technology. The GOLD Certification performs an in-depth diagnosis including a complete battery State of Health analysis, a detailed report, and the premium label.

8. Vehicle Eligibility

Certification is reserved for electric and hybrid vehicles meeting the eligibility criteria published on hecc-certification.com. The client is solely responsible for verifying their vehicle eligibility before placing an order.

9. Certification Process

Certification is carried out at an HECC-approved partner center or, if the selected center offers this service, directly at the client's location. Travel fees may then be charged by the partner center. Appointments are made via the HECC application or directly with a partner center. The certificate is issued within a maximum of 48 hours after the inspection.

10. Badge and Proof of Certification

Every successful certification results in the application of a secure badge (silver for SILVER Certification, gold for GOLD Certification) on the vehicle's windshield, bearing a unique QR Code enabling instant verification of the certificate's authenticity on hecc-certification.com. An official certificate (printed or PDF) is also provided to the client. If no badge or certificate is issued, the client is invited to report this through the HECC application.

11. Failed Certification

If the vehicle does not meet the HECC protocol criteria, a failure certificate is issued to the client, detailing the precise reasons for rejection. No badge is applied. After any repair or restoration, a complete new diagnosis is mandatory to validate certification, and will be subject to new billing at the applicable rate.

12. Liability During Diagnosis

HECC certification protocols constitute rigorous audits of the vehicle's high-voltage systems. In rare cases, this stress test may reveal or amplify a pre-existing weakness. Approved partner centers cannot be held responsible for breakdowns or failures related to the vehicle's intrinsic condition at the time of diagnosis. Any restoration work remains the sole responsibility of the owner.

13. No Implied Warranty

The HECC certificate attests to the vehicle's condition at the time of diagnosis only. It does not constitute a commercial warranty, nor a commitment regarding the vehicle's future performance. It does not replace a traditional mechanical inspection, a vehicle history report, or any other form of insurance or guarantee. Any decision to buy, sell or insure based on the certificate is the sole responsibility of the client.

14. Certificate Validity

The HECC certificate is valid for 12 months from its date of issue. A new certification must be obtained upon expiry to maintain validity.

15. Shop — Available Products

HECC Certification offers, via its platform and mobile application, products related to electric mobility, including batteries and battery reconditioning services for eligible electric and hybrid vehicles. Available products, their technical specifications and prices are indicated on the platform at the time of order.

16. Product Warranties

Products sold via the HECC shop benefit from the following warranties: new batteries are warranted for 1 year, unlimited mileage, from the date of purchase. Reconditioned batteries are warranted for 3 months, unlimited mileage, from the date of installation. These warranties cover manufacturing or reconditioning defects and are exercised through the partner center that carried out the service.

17. Reconditioning — Quote Revision

In the context of a battery reconditioning service, an initial quote is established based on information available before work begins. This quote may be revised upward following in-depth diagnosis, disassembly and/or physical workshop testing. The client will be informed of any price revision before work continues. Should the client refuse the revised quote, any diagnosis and disassembly costs already incurred remain payable by the client.

18. Certification Pricing

Certification fees are freely set by each partner center and may vary from one center to another. HECC Certification is not responsible for pricing changes decided by its partners. Indicative prices displayed on the website and application may not reflect the final price applied by the center. Clients are encouraged to confirm pricing directly with the partner center before placing an order.

19. Payment

Payment may be required at the time of booking or at the time of service, depending on the conditions of each partner center. Accepted payment methods are those offered by the relevant center. Any non-payment results in the suspension or cancellation of the certification.

20. Cancellation and Refund

Once the appointment is confirmed, the client may request a cancellation. Any refund is at the sole discretion of the partner center. In principle, any cancelled appointment does not give rise to a refund; the client is invited to agree on a new date with the center. HECC Certification does not intervene in the refund decisions of partner centers.
